Illyr is a solicitor with over 20 years’ Real Estate Disputes expertise acting for both commercial and residential, landlords and tenants. He has extensive experience and knowledge of real estate litigation and dispute resolution including landlord and tenant issues, acquisition and disposal advice, site assembly projects, development work and property management.

He has acted for a wide range of clients such as multi-nationals, PLCs, property investors, house builders, developers, portfolio managers, landlords and tenants, local authorities, small businesses and individuals.

He advises on the usual pure commercial real estate issues such as Landlord and Tenant Act 1954 security of tenure claims, drafting and advising on real estate notices (such as break notices, s25/26/27 notices, dilapidations/reinstatement notices), sale and purchase contracts relating to land, rights of pre-emption, forfeiture /relief claims, party walls disputes, commercial rent arrears recovery (CRAR) and the full spectrum of real estate insolvency work.

  • Advising commercial/residential property owners/developers on property management issues such as recovering arears, obtaining possession and service charge disputes

  • Acting for a group of foreign investors in a company owning and operating commercial properties letting to national gym franchises and hotel chains.

  • Advising international group of investors following the collapse of a fraudulent investment scheme involving assets in the hotel and leisure sector and in the care homes sector.

  • Acting for a UK property developer (and landlord) against a national hospitality sector tenant in relation to rent arrears and that tenant’s subsequent CVA .

  • Advising a property owner in Surrey relating to disputed parking rights resulting in defeating the counterparty claim, obtaining injunctive relief (preventing further parking infringements) and recovered over £150,000 worth of client costs.  

  • Acted for owners of a property in South Kensington, London facing a claim for £2.5 million from adjoining owners in respect of the incorporation of a communal staircase to the clients’ property. Successfully negotiating a settlement of the claim (together with costs paid by insurers).

  • Acting for a property developer landlord in a contested lease renewal with a major supermarket following the acquisition of a shopping centre.
